Can I visit to inspect the lots ?

In general, we organise a one-day visit per auction so that potential buyers can inspect items before the auction closes. This information can be found in the specific terms of sale. Before purchasing, we recommend that you come to inspect all items on site. All items are sold without warranty, even if the type, state, quality or name does not comply with the description given on the website. Bidders acquire goods in the state in which they are found and cannot remove their bid or cancel the purchase.

How do I bid ?

To bid, you must be connected to your user account on clicpublic.be.
Only our bidding system is able to receive bids proposals. As such, bids will not be accepted by e-mail, phone, fax, letter, or in our offices.

After an item or lot put up for auction is selected, its details appear.

A. Important, before placing a bid, you should read the following articles first:

1. The specific terms of sale
On each product card, you will find information relating to the relevant item or lot. The most important information is listed :
- The description of the item or lot
- The date and time the auction closes
- The current bid and the next minimum authorised
- The current bid, VAT included. Additional costs may be stipulated in the “specific terms and condition” section. These additional costs shall be borne by the buyer and are payable in addition to the amount of the assigned item, for example, the cost to dismantle and ship exceptional items.

We recommend that you select “Add to watchlist” for items and lots you find interesting. In your “My account” zone, you can view all goods and items you are watching to keep informed on how bids are progressing.

Before you are able to confirm a bid, you must accept the terms and conditions as well as the specific terms of sale. This can be done by clicking on the tab displayed when you validate your bid.

You receive an e-mail :
- for each successful bid for an item or a lot
- for each higher bid that exceeds your last bid
- if there is a higher bid for a lot that your item belongs to.

B. Bids may be placed as a maximum bid or a fixed bid.

1. Fixed bid
A fixed bid, is a bid at a fixed one-off amount for an item or a lot. If a bidder places a bid that is higher than yours, you can place a new bid to become the highest bidder again.

2. Maximum bid
With a maximum bid, you indicate the maximum amount you are willing to pay for an item or a lot. This system allows you to place a higher bid automatically when another bidder places a bid. And this, until your maximum bid is reached. This does not necessarily correspond to the maximum amount you entered as your maximum bid, but the amount for the next acceptable bid. The user can temporarily cancel his maximum bid, by placing a fixed bid, which for the moment, is the highest. It is not possible to cancel a bid, neither through a fixed bid nor through a maximum bid less than your current bid. All bids placed are unconditional and irrevocable.

C. In the bid details, you will find information relating to the bid you have placed.
In addition to the minimum starting bid or the current bid, the following information is also provided:
- Bottom price met: Informs you that the item will be assigned to the buyer that has placed the highest bid, subject to validation by the principal.
- Bottom price not met: Informs you that the previously fixed minimum amount to obtain the item has not yet been met. As soon as this amount is met, the wording “bottom price met” is displayed.
- Temporary assignment: Informs you that the bid you have placed for the item or lot is the highest at the end of the auction. Your bid will be proposed to our principal. Clicpublic.be will inform you if the item is assigned to you or not.

The amount of VAT included is also indicated. It is possible that additional fees are requested for a specific item or lot. For example, these additional costs may correspond to dismantling goods or shipping fees and must be paid by the buyer in addition to the amount indicated for the item or lot.

D. My watchlist
If you have placed a bid for an item, it automatically appears in the “My watchlist” section. Click on "My watchlist" in the left menu in "My account". Here you can check if you are still the highest bidder for the item, or if you have lost the upper hand for one or several item(s). For each item or lot, you can also click on “Add to watchlist”. The item or lot then appears in the “My watchlist” section. You are now informed of any bids placed for the item or lot. You can click on “Do not watch this item any longer” if you want to remove it from the watchlist.

E. Public tender / auction
An auction by public tender is an auction that requests a bid from the buyer. This bid is secret; it will not be disclosed and cannot be seen by any other buyer.
You can place a bid, just like an on-line bid, with the maximum amount you are willing to pay for the item. You can place several bids for the same item, but each bid must be higher than the previous bid. You will receive confirmation of each bid proposed and you can consult your bids in “My account”. After bidding is closed, bidders will receive an e-mail from Clicpublic SPRL to inform them whether their bid has been accepted or not by our principal.

Selling costs?

Selling costs are directly included in the bid you place at an auction or for a direct buy. The bid amount you place does not include VAT. To avoid unpleasant surprises, our system indicates in real time (immediately) your bid amount, including VAT.

Top of the page

How can I obtain priority for a lot in relation with the items it comprises ?

A lot is a combination of items. In general, items are sold separately, under the condition precedent of a higher offer for the lot. In this case, the lot (combination of items) has priority. A bid can be placed for a lot. However, it can only be assigned to the buyer if his bid is a least 10% higher than the sum of bids placed on the items that comprise this lot. Failing bids placed for the lot, the separate assignment of items shall be final.

Top of the page

What does “bottom price met” and "bottom price not met” mean ?

The principal has the possibility to set a minimum selling price for items. Once the auction closes, if the bottom price has not been met for certain items, the principal reserves the right to assign the item or not. If necessary, if the principal does not grant approval, the lot will not be assigned and will be removed from the sale.

Top of the page

Closing of the on-line auction

The auction closes at a specific date and time. You can find these details, among other things, in the specific conditions. From that moment, our principal will inform us if the property for which you have won the auction you are assigned or not.

If items or lots are assigned to you, you will receive an e-mail informing you that you can proceed to payment. Our principal will grant approval for the assignment within two business days. If the item is not assigned to you, you will receive an e-mail advising you as such.

Top of the page

What does “temporary assignment” and “final assignment” mean ?

If you are the highest bidder, after the on-line auction is closed, the lots will temporarily be assigned to you. This means that your bid, which is the highest, will be proposed to our principal for approval. Once approval given, your bid will be final and the sales contract will be drawn up. An e-mail will be sent to you with a request for payment. If the principal does not grant approval, the lots will be withheld. In all cases, clicpublic.be will send you the principal’s decision.

Top of the page

Top of the page

Is it possible to return goods?

Clicpublic SPRL does not accept the return of items. The application of Articles 1649, 1684 et 2280 of the Code Civil shall be accepted by the buyer. Each buyer acknowledges that he is informed and that he shall have no recourse. Due to the nature of the activities of Clicpublic SPRL, i.e. the auction of goods coming from bankruptcies, seizures, judicial liquidations and unclaimed estates, the law on market practices and the protection of consumers does not apply, as specified under article 65 of the law on market practices and the protection of consumers. The buyer explicitly agrees with the fact that goods that have been used for the business activities of the bankrupt company, or a company subject to a judicial reorganisation, are goods which have already been subject to normal use, and that they may or may not, show traces of use.
We recommend that you inspect the goods onsite during the viewing days. This helps avoid any unpleasant surprises. It is assumed that the buyer has correctly inspected the lots sold with no warranty, even if the nature, state, quality or name does not comply with the description given on the website. Bidders acquire goods in the state in which they are found and cannot withdraw their bid or cancel the purchase.

Collection takes place on premises that do not belong to us, and our staff are only present on the date and time stated in the sale. It is therefore impossible to provide access at any other time. You may appoint another person to come and collect the goods.

If the goods are not collected on the date indicated, they will be abandoned on the premises and will automatically be invoiced, with no possibility of recovering them.
